Brentwood does not require a sewer lateral inspection or compliance certificate to close escrow. The East Bay program that does require one covers Alameda, Albany, Emeryville, Oakland, Piedmont, El Cerrito, Kensington and the Richmond Annex. Brentwood is not in it, is not in EBMUD's service area at all, and has no equivalent rule of its own.

What is the East Bay sewer lateral program, and where does it apply?
It is EBMUD's Regional Private Sewer Lateral Program, and it requires property owners to hold a compliance certificate showing their private lateral is leak-free, verified by camera inspection and a leak test.
Three things trigger it: buying or selling a property, where the certificate is required to close escrow; building or remodeling in excess of $100,000, where it is required for final permit sign-off; and changing water meter size.
The certificate lasts twenty years if you fully replaced the lateral and seven years if you repaired it or simply passed the test. The certificate fee itself is $407, which is the administrative charge for the verification test and not the cost of the camera inspection, the test appointment or any repair work. Those are contractor costs and they vary widely.
Berkeley runs its own separate program.
Why doesn't it reach Brentwood?
Because EBMUD's wastewater service area stops well west of here.
EBMUD treats wastewater for nine communities along the eastern shore of the bay, and its own description of its boundary runs from Crockett south to San Lorenzo and east from San Francisco to Walnut Creek and through the San Ramon Valley. Brentwood sits well east of that line.
EBMUD is not Brentwood's water provider either. Brentwood's water comes from the city's own groundwater wells and from treated surface water, and the city runs its own wastewater treatment plant.
Two neighboring agencies have said the same thing about their own territory, in writing. Central Contra Costa Sanitary District states that it does not have a point of sale sewer lateral inspection ordinance, and that inspection before a sale is encouraged but not required. Delta Diablo, which serves Antioch, Pittsburg and Bay Point, states that it does not require sewer lateral certifications for property sales.
What are the actual Brentwood rules?
Brentwood Municipal Code Chapter 13.04, Article 8 governs sewer connection and lateral maintenance. It contains no provision requiring an inspection, test or certificate on sale, and no remodeling dollar threshold.
What it does contain is worth knowing.
Responsibility splits at the property line. The owner maintains, repairs and replaces the lateral from the property line back to the building. The city maintains from the property line, where an approved cleanout must be installed, out to the main. The city also runs a residential lateral maintenance program for single-family homes covering that property-line-to-main segment, and there is a monthly sewer lateral maintenance charge on the city utility bill, currently $4.34.
Minimum lateral diameter is six inches, or four inches for residential buildings of six or fewer units.
The owner has a standing duty to keep the private lateral in working condition and prevent overflows, with twenty-four hours to abate an overflow after the city gives notice.
Should you inspect anyway?
Often, yes. Not because a rule says so, but because of what the house is.
A camera inspection is one of the cheapest ways to find an expensive problem, and the case for it strengthens with the age of the tract, the size of the trees between the house and the street, and any history of slow drains or backups. On a newer Brentwood home with no symptoms it is a judgment call. On an older one it is usually money well spent.
What you should not do is skip it on the theory that a required inspection would have caught anything serious. In Brentwood there is no required inspection to rely on.
If you're buying or selling in Brentwood
If you're buying: order the camera inspection as part of your general inspection rather than as a separate errand, and ask the inspector to note the cleanout location. If the report finds a defect, remember the split at the property line determines who owns the fix.
If you're selling: if someone tells you that you need a compliance certificate to close, ask which agency requires it. In Brentwood, none does. If you have had backups, that is a known condition and it belongs on your disclosures whether or not any ordinance mentions laterals.
